COBOURG, ONT. – Moffat Bros. Roofing Ltd. of Cobourg, Ont. has been fined $100,000 in relation to an August 2023 incident where a worker was injured after a fall.

At a project in Port Hope on Aug. 1, 2023, a worker employed by Moffat Bros. Roofing Ltd. was completing a steel roof replacement.

The worker was clipped to the tether rope of a safety line, but it was not long enough to reach the position required to install the final roof panel. As a result, the worker unclipped the safety line. 

The worker then attempted to step over a steel panel being fastened to the roof, lost their balance, and fell approximately 22 feet to the ground, sustaining critical injuries, an Ontario court bulletin describes. 

The worker was not using any method of fall protection at the time of the incident, despite fall protection equipment being available onsite.

The company failed to ensure the measures and procedures prescribed by section 26.1(2) of Ontario Regulation 213/91 were carried out in the workplace contrary to section 25(1)(c) of the Occupational Health and Safety Act.

Following a guilty plea in the Provincial Offences Court in Cobourg on June 3, 2026, Moffat Bros. Roofing Ltd. was fined by Justice of the Peace Joel Kulmatycki.
