The Office for Nuclear Regulation (ONR) has notified Balfour Beatty Group that it will be prosecuted for a health and safety offence following a worker fatality at a nuclear licensed site. 

The charge relates to an incident that occurred at the Atomic Weapons Establishment (AWE) Aldermaston site in Berkshire, where nuclear weapons are made, on 6th July 2023. A 58-year-old male construction worker from East London died after sustaining fatal injuries.

The prosecution relates to alleged breaches of the Health and Safety at Work etc. Act 1974 Section 2(1), and 3(1).

The decision to begin legal proceedings follows an investigation into the incident by ONR, the UK’s independent nuclear regulator.

The incident was a conventional health and safety matter, and there was no radiological risk to the public, the ONR said.

Court proceedings are now under way, although no date has been set yet for the first hearing.
